1. Overview

This website, dubey.it, and all related content, features, tools, products and services (the "Services") are operated by Florence Leather di Salaria Kiran, Via di Terranuova 4B, no. 4, 52025 Montevarchi (AR), Italy, VAT No. 02240290516 ("Dubey", "we", "us", "our"). The Services are powered by Shopify.

By visiting the website, creating an account or buying from us, you agree to these Terms of Service (the "Terms"), together with the policies referenced here: the Privacy Policy, the Terms and Conditions of Sale and the Refund Policy. If you do not agree, please do not use the Services.

Please read these Terms carefully. We may update them from time to time (see Section 14).

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Services or place an order. By using the Services, you confirm that you have the legal capacity to enter into these Terms. If you use the Services on behalf of a company, you confirm that you are authorised to bind it.

3. Use of the Services

You agree to use the Services only for lawful purposes and in line with these Terms. You must not:

  • Use the Services in any way that breaches applicable law or the rights of others.

  • Transmit viruses, malicious code, or anything that could damage or disrupt the Services.

  • Attempt to gain unauthorised access to the website, other accounts, servers or networks.

  • Use bots, scrapers or automated tools to extract data or place orders, except as permitted by law.

  • Submit false, misleading or fraudulent information, including false payment details.

  • Use the Services to resell our products commercially without our written consent.

  • Interfere with the security features of the Services.

We may suspend or restrict access if we reasonably believe you have breached these Terms.

4. Your Account

You may be able to create an account to check out faster and view your order history. You agree to give accurate and current information and to keep it updated. You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at florenceleather@outlook.it if you suspect unauthorised use. We may close or suspend an inactive account, used fraudulently or in breach of these Terms. You may close your account at any time by contacting us.

5. Products, Pricing and Orders

Our jackets are hand-dyed and crafted in Florence, Italy. Natural variations in leather, colour and finish are part of the product. We make reasonable efforts to describe products and show colours accurately, but we cannot guarantee that your screen display is exact. Prices and availability may change without notice.

The ordering process, payment, delivery, returns and our liability for purchases are set out in the Terms and Conditions of Sale, which apply in addition to these Terms. If there is a conflict between these Terms and the Terms and Conditions of Sale about a purchase, the Terms and Conditions of Sale prevail. If there is a conflict between either document and the Privacy Policy about your personal information, the Privacy Policy prevails.

6. Intellectual Property

All content on the Services, including text, photographs, product designs, graphics, logos, the Dubey name and monogram, and the layout of the website, is owned by Dubey or its licensors and is protected by copyright, trademark and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to view the website and use it for personal, non-commercial purposes, including to browse and buy products. You may not copy, reproduce, modify, distribute, publicly display or create derivative works from our content without our prior written permission. All rights not expressly granted are reserved.

7. User Content and Reviews

If you post reviews, comments, photos or other content ("User Content") or send us material, you confirm that you own it or have the right to share it, and that it is lawful, accurate and does not infringe anyone's rights. You must not post content that is defamatory, offensive, hateful, unlawful or that contains personal data of others.

You keep ownership of your User Content, but you grant Dubey a worldwide, non-exclusive, royalty-free licence to use, display, reproduce and adapt it in connection with operating and promoting the Services and our business. We may remove User Content at our discretion, for example if it breaches these Terms. We do not endorse opinions expressed by users.

8. Third-Party Services and Links

The Services rely on third-party providers, including Shopify, payment processors and carriers, and may link to third-party websites. Those third parties have their own terms and privacy policies, and we are not responsible for their content, availability, or practices. Linking does not imply endorsement. Please review their terms before using them.

9. Errors and Availability

We try to keep the Services accurate, secure and available, but we do not guarantee that they will always be uninterrupted, error-free or free of harmful components. Information may occasionally contain typographical errors, inaccuracies or omissions, for example about pricing, availability or descriptions. We reserve the right to correct errors and to update or cancel orders affected by an obvious error, with a full refund where you have paid. We may modify or discontinue any part of the Services at any time.

10. Disclaimer and Limitation of Liability

10.1 Mandatory rights. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, wilful misconduct or gross negligence, or your rights as a consumer under mandatory consumer protection law.

10.2 Services provided as available. Subject to Section 10.1 and to the extent permitted by law, the website and its content are provided "as is" and "as available" without warranties of any kind regarding the website itself, its uninterrupted operation or the accuracy of content. This does not affect any legal guarantee that applies to products you purchase, which is described in the Terms and Conditions of Sale.

10.3 Limitation. Subject to Section 10.1 and to the extent permitted by law, Dubey and its owners, staff, suppliers and service providers are not liable for indirect or consequential loss, loss of profit, data, goodwill or opportunity, or for losses caused by events outside our reasonable control, arising from your use of, or inability to use, the Services. For users who are not consumers, our total liability relating to the website is limited to [EUR 100 / the amount you paid us in the preceding 12 months]. Liability connected with purchases is dealt with in the Terms and Conditions of Sale.

11. Indemnification

To the extent permitted by law and where you are not acting as a consumer, you agree to indemnify and hold harmless Dubey and its owners, staff and partners from claims, losses and reasonable legal fees arising from your breach of these Terms, your User Content, or your violation of law or third-party rights. This clause does not apply to consumers to the extent that it would limit their mandatory rights.

12. Privacy and Cookies

How we collect and use your personal information is described in our Privacy Policy at https://dubey.it/policies/privacy-policy. By using the Services, you acknowledge that policy. The website uses cookies and similar technologies, and where required by law, we ask for your consent before setting non-essential cookies.

13. Termination

These Terms apply for as long as you use the Services. You may stop using the Services at any time. We may suspend or end your access, without liability, if you breach these Terms or if we are required to do so by law. Provisions that by their nature should continue, such as intellectual property, limitation of liability and governing law, will survive termination. Termination does not affect orders already placed and accepted.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, the Services or the law. The updated version will be posted on this page with a new "Last updated" date and takes effect when posted. Continued use of the Services after changes means you accept them. Changes do not affect orders placed before the change. Where required by law, we will give you notice of material changes.

15. Governing Law and Disputes

These Terms are governed by Italian law. If you are a consumer habitually resident in another country, you keep the benefit of the mandatory consumer protection provisions of the law of your country of residence. Disputes with consumers fall within the jurisdiction of the courts determined by mandatory law, which in the EU is generally the consumer's place of residence. For all other users, the courts of Arezzo, Italy have exclusive jurisdiction. Information on out-of-court dispute resolution for EU consumers is available at https://consumer-redress.ec.europa.eu. We encourage you to contact us first so that we can try to resolve any complaint informally.

16. General Provisions

  • Entire agreement. These Terms, with the policies they refer to, are the entire agreement between you and Dubey concerning the Services.

  • Severability. If any provision is found invalid or unenforceable, the rest remains in effect.

  • No waiver. Failing to enforce a right is not a waiver of it.

  • Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor of our business.

  • Language. These Terms are drafted in English. Any translation is provided for convenience, and the English version prevails unless mandatory law provides otherwise.
